Saturday, January 11th
Another beautiful morning here, hard to believe the winds causing all that fire devastation an hour away are keeping us with good weather. I’d trade our weather for rain in a minute if it would help. This whole fire situation is just awful for all impacted.
Good news is that my girlfriend/partner drove up this morning to visit, made it in record time as freeway traffic is light everywhere. So we had a terrify visit till 2:30. Been 60 days since we saw each other, withher grandson being born in-between,so was just great to spend some quality time together. Same for tomorrow assuming no fog or lockdown:)
Pretty much spent the rest of the day on NFL Wildcard weekend, lockdown and reading. Its gotten really cold at night this week, lows 31-35, so thankfully I have thermals and sweats and 2 blankets to sleep in. Seems to do the trick!
Sunday, January 12th
Beautiful and cold this morning. Finished my visit late morning and she headed back and apparently made record time again!
Went to church 12:30-2, outside workout 2-3, followed pretty much the same routine as yesterday for the remainder of the day/evening.
This morning before our visit, made good progress helping Jorge on his stuff to get early home release to take care of his daughter. A BP-9, a letter to the Warden requesting empathy. Final document will be a Release Plan giving the Warden/BOP comfort he has a job/income at home, and the wherewithal to care for his daughter. He has an updated doctor letter explaining all his daughter’s issues, and that he is instrumental to bringing her to appointments plus providing the emotional support she needs.
End of the day, during the Washington/Tampa wildcard game, took a break and sent an email to 4 people asking them to apply on DOGE for me. Augmenting my son’s application he did for me, hoping this might get their attention!
Monday, January 13th
Woke up today dreading the thought of going outside this morning after commissary, lugging all our groceries around all day in our nylon laundry bag. At 7:30 thought I was going to the library but the guards only let us go to the commissary. I had my bag with 20 lbs. of stuff for all day outside with me. But surprisingly, when we left the commissary, they sent us back to our Unit and we didn’t go outside. So I had the good fortune of only dragging a 20 lb. bag to commissary for an hour vs, 70 lb. bag all day out of the Yard and back to he Unit. I call that a W!
So at 9 took advantage of being in the Unit and hit the PC till 2, on and off every 20 minutes or so. At 2, got outside for a good workout till 3. Lockdown, chow and wild card game, LA Rams v. Minnesota. All in a decent day.
Tuesday, January 14th
I tried to thread the needle this morning by taking a later shower at 7, so I could watch confirmation hearings, then went to medical at 8, not sure if we were getting kicked out or not. Ended up meeting with the Head Clinical Doctor and his #2 doctor, and was finally able to give them both my lab results from a year ago, 12/23, explaining them with my doctor’s letter. After 10 months finally! They wee very appreciative and reiterated their desire to help me. Next step is they are emailing the information to the head Western Regional Doctor and I’m to come back the first week of February. Feels like small step for mankind!
Of course we didn’t go outside again, so I brought my bag to medical for nothing. But I’m not complaining, nice to have another day inside! At 11, went to dental for the fist of 3 visits- x-rays today, then exam, then cleaning. I can honestly say this dental team is on it! One year to the day and I’m in for an annual exam.
Had an outstanding workout 1-3 on a gorgeous afternoon, 69 or so. I still can’t comprehend our weather with these wildfires so close. Its like a whole other universe.
I decided yesterday to reread all 3 appeal filings and the governments response to Rice. 45 days removed form filing, there’s some real clarity to me re-reading them. Tomorrow I’m making some notes for counsel, as she will have similar responses to ours on a couple of topics which over lap.
Today was one of those days that happen every 30-60 days here, when things just seem to go smoothly like they ought to. I have no clue how to have this more often:)
Wednesday, January 15th
Well my day is all planned, so off to library/education at 7:30 until 10. Guessing we’re going outside again. But after 30 minutes the guards ordered everyone prisoner back to their cells at 8, guess something going on. And yesterday was so smooth!
Well,turns out the neighboring “low security” facility had a small kitchen fire, not sure why that impacts us but what do I know? After 90 minutes , they told us we were going outside at 10, which we did. So did 10-12 outside including chow, then Round 2 at library 12-2, followed by 12-2 outside again for a good workout. 71 today, middle of January! So much better than last year when I first got here!
3:30-6:30 are lockdown, chow and TV. Since I got 7 newspapers today, spent the evening reading them plus doing random emails.
Library was productive researching the cases the government cited responding to my co defendants appeal. I’m analyzing all this as three of his topics are the same as mine, so trying to extrapolate their arguments to the response coming January 24th to my appeal. Tomorrow I will review all my notes from rereading, plus these cases, and form an email to send counsel. That plus helping Jorge on his Release Plan so he can file his BP-9 to try and get back to helping his daughter,
On the way back from outside today, another inmate, Bishop, asked me to help him qualify for First Step Act credits. He is another one with one sentence eligible(drugs) and one ineligible(gun). That’s three I’m helping with this issue, so I will try three separate arguments around “Loper” reversing “Chevron deference” to see which the judges are more sympathetic to. Kind of like a needle in a haystack, finding the right judge who can look past all the case law since 1984 and who has original thoughts and desires to look at things fresh! In other words good luck to me:)
Thursday, January 16th
Another day outside the Unit, so headed to Education/Library today. Thankfully no drama today:) Made more progress on Jorge’s Release Plan among other things. Helped my friend Steve refile his BP-11 as he didn’t follow my instructions and they rejected his last filing on December 7. Interesting how he didn’t get it until January 7, and then another week to our Unit. Now that his case manager told him there is no evidence of a writeup or hearing in the computer, makes our revisions pretty easy. Even though the BP-10 response from Western Region’s counsel denied his claim due to the ” evidence” now Steve can call out their misrepresentations of fact.
Outside 10:30-2, had a strong 90 minute workout as well. Sunny, 70, no wind, but we know that’s changing beginning tomorrow with 60/31 the temps. That the January I remember, probably some wind in there as well:)
2-3, back to library, then lockdown 3:30-5. We made a great rice bowl during lockdown as we weren’t going to eat hot dogs and 2 dry buns. TV, power typing the rest of the evening. I learned last night Derek, my partner in crime with “A Better Tomorrow” is finally getting released February 6, so I’m in high gear to finish typing Section IV and finish writing a couple remaining chapters as well.
Friday, January 17th
Our Unit was back outside again, so I was in Education/library 7:30-10. Worked on my appeal email plus Jorge’s Release Plan. Definitely have a cold coming on, I can feel the congestion.
10:30-1 outside including chow. Today the temp was 10 degrees less, or 60, but with a cold wind off the ocean. At least sunny…. 1-3 back in the library then lockdown/chow. My dear friend since 3rd grade sent a book which I received tonight,
” Mysterious Case of Rudolph Diesel”, of diesel engine fame. A well researched story of his death in 1913 right when the entire world was adopting diesel engines to replace steam engines. A lot of controversy over the cause of his death, so should be a great read. Perfect timing! No football sadly so lots of reading and typing tonight!
