I am currently serving out my 23rd year of a 360 month sentence for Conspiracy, possession and distribution of cocaine (Powder) offenses taken from the United States District Court for the Eastern District of Wisconsin Milwaukee in criminal case no. 02-CR-00075-2-LA.
This as the result of a conviction after trial by jury.
I have been at all levels of the Federal Criminal Justice system, including the Federal Bureau of Prisons, to where I have been housed in High, Medium and low-security facilities, including holdover and county jail facilities all across the United States.
I have activated 3 federal prisons, and am now housed at the FCI SAFFORD (low) and have been so for the last 7 years.
I have since, taken to the study of federal law which I have dedicated virtually every waking hour to such. This where after years, I have advocated as a prisoner, pro se litigant for prisoners in the FBOP in a litany of proceedings and procedures in federal, state and local matters and continue to do so to this very day. I have recently obtained my paralegal-legal assistant diploma from the Blackstone career Institute, and am currently working on specialty courses the same.
I am a native of Milwaukee, Wisconsin, however, the extent and factual allegation of the conspiracy charged against me, stemmed from California, Arizona, Illinois and Milwaukee. Though I was a mere 23 years old upon my arrest, this is not my first stint, nor run-in with the law. However, all of the adult convictions that I have, are all misdemeanors for assault, and I do have juvenile offenses to include robbery and theft. I am now a 45 year old grown man.
I am also a member of the clergy as a licensed and ordained minister of the Christian faith. I am active in the ministry here in the facility, and the FBOP.
I have 2 children, one of which was 4 months old (son) when I was arrested, and one who was born 2 weeks after my arrest (Daughter) to which I have never physically touched due to my placement across the U.S. I have not seen my son since 2009.
I will spare the intricacies of the plethora of claims of violations of my right(s) in the prosecution against me, and the government’s misconduct and fraudulent behavior in connection thereto, nor the lawyer-double agent that I was appointed, however, these accusations are well-recorded in many filings, published and not, however, and now, that I do not qualify for any reductions in sentence over the years of the many Amendments to the U.S. Sentencing Guidelines, and many Court decisions. Neither the recent amendments.
I have been denied clemency by Barrack Obama, and Biden, Trump neglected the documents to which sat on his desk for over 2 years.
Subsequent the First Step Act, I wrestled during the COVID-19 lockdowns with a Case Manager that was essentially a government/U.S. Probation Officer masquerading as a prison official, that would not qualify me as ” eligible ” under the FSA provisions for Evidence Based Recidivist Reduction Programing, Earned Time Credits under 18 U.S.C. Section 3632(d)(4)(A). I prevailed and had retrospectively applied the FTC’s to my projected release date, and other crediting ! I effectually began to actually facilitate 4 of the programs that the FSA provides.
I also assist in the appellate process’ for numerous other prisoners, including immigrants that are plaguing our system to make the determination of whether or not they qualify, and to actually apply their earned time credits this is not well-taken by the administration and those that simply refuse to adequately discharge the duty placed upon them by the Congress here in the FBOP.
I ‘ve been attacked and given incident reports for assisting others, and instead of ” taken my FTC’s ” they now raised my PATTERN SCORE and dis-allowed the application of the FTC’s, and thus took all my credits. This for extremely minor incident reports.
All this, while I watch those that do ” nothing, ” no programing, no participation no assistance, receive every single day of their credits and leave to the community with all of the benefits that are available.
God’s will be done. Also, I do not qualify for any relief from my sentence for any of the Residential Drug Abuse Program because of a feigned ” 2 level enhancement for the possession of a firearm, ” under USSG Sec. 2D1.1(b)(1). Even though I went trial, and even though the jury did not find me guilty of a firearm, even though, I was given a guidelines sentence, but the Statement of Reasons states that I did not. Even though that, I was sentenced before 2008 and in the 9th Circuit’s decision in Arrignton V. Daniels,- (9th Cir. 2008) I qualify for such. Don’t let me get started about the soapopera that ensued by my attempts to participate in the program, and when I did ” program ” I was called a ” snitch ” by female correctional officer, and I exploded and left ! Don’t let me get started by the painstaking process I went through to appeal the decision and was denied and rejected at every level of the Administrative remedy process that the FBOP has to offer.
I have come to the conclusion that, I will in fact complete the last 3 1/2 years of my 30 year sentence for a non-violent cocaine powder offense. I am now content with that fact, and I will work diligently to continue to be the man that I have grown to be, I will work diligently to cultivate all of the crafts that the Lord has blessed me with, I will work diligently to not become the person that I could easily become and I will continue to help and not hurt, I will work diligently to be an asset as opposed to a liability to the ” world, ” and most importantly to the ” Kingdom of heaven. “
In the incubation stages of my incarcertation, I wrote movie scripts, I did copyright and make attempts to basically have them produced. However, the FBOP did not like that, so I put them, and my dreams to do that at the bottom of my locker and began to study the law. I have since done so rigorously for 20 years.
As cited, I am now working towards my paralegal career and have obtained my diploma, I am now working on my specialty courses through Blackstone Career Institute. I also physically train through fitness programs numerous prisoners, maintain my own physical fitness, and continue my education in health and wellness daily!
Basically overall, I have utilized my God given time wisely over these years, and pray that one day I am released and allowed to be graced with experiencing the world from this new standpoint. Until then, I am here, I am willing and am grateful.
