MY DAY IN COURT
I am looking at my criminal case today. I currently have two motions in court. one is the result of a supreme court case in 2022 called U.S. v. Taylor. It states that certain attempted robberies are not crimes of violence as it pertains to carrying a firearm because the crime was not completed. The language is the same with attempted Hobbs act robbery, Attempted Bank Robbery and attempted carjacking in many circuits. My circuit, 11th, has ruled against it and it is now on the way to the Supreme court again to resolve the split decisions with a case called Armstrong. My fate lies with him. If he wins I win.
I also have a compassionate release motion in court. I’m asking for a sentence reduction on the grounds that If I were sentenced today, due to changes in the laws, I would have a significantly lower sentence. I was sentenced to 32 years. Someone sentenced under my charges today would receive 14 years. I am doing 18 more years which is a sentencing disparity. Because of the 924(c) gun charges i am not allowed to earn Good time credits. which would give me a 1 year early release and another year half-way house confinement. If you count the drug program other inmates will be released 4 years early when I am only eligible for 1 year half-way house under the second chance act even though I have a very low recidivism score. It makes more since to me that since I will have done over 27 years in prison that I need more time in a half-way house to acclimate myself to the outside world but that is not how it works. That said if God wills it and i lose both cases I should be released in December of 2029. I’ll be almost 58 years old and just starting over. I pray that I’ll have at least 10 years of working ability. its scary. Thanks…LB
