Release Plans: Ryan Nichols

Release Plan

Ryan Nichols
BOP Inmate #26099-509

My father was the first person to teach me about the “6 P’s” growing up – They are: “Proper Preparation Prevents Piss Poor Performance.”

So in order to prevent any further piss poor performances in my life like the performance that led me to prison, I want to demonstrate through this comprehensive and thorough 12 part Release Plan how I’ve positively progressed through my incarceration, and why I am an excellent candidate for release to a Halfway House and/or Home Confinement.

3: Projected Release Planning –

Based on my calculations set forth by the Sentencing Commission, Congress and the BOP, I calculate:

63 month sentence at 85% for good time = 53.55 months

53.55 months remaining minus 28 months served during pre-trial and pre-sentencing = 25.55 months

25.55 months remaining minus being eligible for FSA at the date of sentencing and the completion of the first 6 months after sentencing while being a candidate for low recidivism (10 days off for each 30 days served past sentencing) = 17.55 months (6 months + 2 months good time)

17.55 months remaining minus the beginning of the 7+ month after sentencing with the FSA and being a candidate for low recidivism (15 days off for each 30 days served after the first 6 months past sentencing) = 11.5 months after 10 months past sentencing on 3/2/25 (4 months + 2 months good time credit)

11.55 months remaining with the Second Chance Act allows for the eligibility of a halfway house up to 12 months out from release date.

With these projections, and at the blessing of the BOP, I am projected to be released to a halfway house by 3/2/2025.

If I am allowed to work at Unicore which I will as quickly as allowed, my release date is subject to be much sooner after the completion of 500 hours. If allowed to work 5 days per week at 7 hours per day, that would mean I am eligible for halfway house within 3.5 months of the date I am allowed to start working.

If I am allowed to do more programming and other courses, there will also be additional time off, which will also change the dates.

I understand that these dates are subject to change with my Counselor and Unit Teams Case Manager.

4: Background – See Biography

5: My Conviction – (Include Allocution)

I was convicted of 18 USC 111(a) and 18 USC 1512(c)(2) – Those being Assault and Obstruction Of An Official Proceeding.

6: Making Amends – (Include Allocution)

7: Community Support – (Include Support Letters)

I have a large central support group at home, which includes my wife, children, parents, in-laws, business partners, attorney, staff members, non-profit partners, church family, and other leaders within our community.

My support group has come together and written testimonial and support letters for me, and I am including those here.

8: Medical Prescriptions –

a: I am currently prescribed Zoloft for my diagnosed PTSD from the Marine Corps and Search And Rescue operations.
b: For Hypothyroidism, I am prescribed LevoThyroxine.
c: I have extremely low Testosterone levels, for which I am prescribed Testosterone.
d: For help sleeping, I am prescribed Trazodone.

My Primary Care Provider is Dr. Sims at Diagnostic Clinic of Longview. He is aware of my situation, and is looking forward to seeing and treating me as soon as I am released.

I also look forward to taking marriage counseling and mental health classes when I get released to better not only myself but my family as well.

9: Financial Obligations – (Include court order on fine)

Judge Lamberth ordered that I pay restitution in the amount of $2,000, a $200 special assessment fee, and a fine of $200,000 – totaling $202,200. My plan is to work at Unicore and pay as much as required monthly to meet the satisfaction of the court and BOP.

Upon release, I will be working at Wholesale Universe, which is a successful wholesale and retail company that my wife Bonnie and I have owned since July 27, 2015. Before arrest, I drew a paycheck of $5,000-$7,000 each month, and am cleared to do that again upon release.

I look forward to paying off my debts that I owe to the United States, and am looking forward to making my fines and restitution whole. My business helps other business owners grow their businesses with the products and services we offer, so I receive great joy by working 40-50+ hours per week in the business that I founded with my wife.

10: Risk And Needs Assessment –

I have not taken my risks and needs PATTERN assessment surveys yet, but my intention is to do that as soon as they are made available to me.

With my personal history, no past criminal history, and behavior while incarcerated, I am more than certain that I will be a candidate for low recidivism.

11: Personal Plan –

There are lots of plans I have made over the last 3.5 years since this journey first began that I’d like to implement into my life. First and foremost, I want to continue being the father and husband to my wife and children that I was before my arrest. Being a present husband and dad was and still is the most important thing in my life. These last few years have taken a toll on not only me, but my family as well, and I need to rekindle the flame that my family and I once had, and grow the relationships with my wife and my sons. Furthermore, I need to teach my sons that there is nothing in life that you can’t bounce back from and overcome, and that this bad situation didn’t make dad love them any less, nor define his life.

I will be taking my family fishing, out to eat, camping, to and from school, to sports practices and games, swimming with them in our new pool in our backyard, playing video games with my sons, going to church together at Mobberly Baptist Church where we have been members for years, going on dates with my wife weekly, riding around our neighborhood in the side by side my wife purchased, and much more. There is no making up for the time I lost with my family, but I can make sure to be a present father and husband for now on. That is my intention.

As presented above, I will be working at the company my wife own and started in 2015. I work anywhere between 8-16 hours per day at Wholesale Universe, Inc., and am looking forward to getting back to the company that I love and the staff members (40-60+ staff) who I enjoy spending time with.

Furthermore, I plan on opening a Non-Profit organization called “Convicted Veterans” which will serve to help incarcerated veterans who have been convicted of crimes and need help growing physically, mentally and spiritually while locked up and upon release. For the last 12 months, I have been planning and organizing this organization by putting together a comprehensive and in-depth curriculum, weekly newsletters, a reading list, workout plans, and the entire organization structure that will be required to make this Non-Profit run effectively.

I also want to help Convicted Veterans with their commissary needs, legal needs, workforce needs (Wholesale Universe hires felons and gives 2nd chances), medical and mental health needs, physical workout needs, and much more. We will do this by creating a environment where they feel safe to gather together and fellowship together. I plan on building a gym in Longview, Texas where I live upon return, and creating meeting spaces within the gym that help incorporate all of this together. The funds created with memberships will be used to fund the non-profit, and it will be a safe space where not just Convicted Veterans, but ANYONE can come to be around in a positive environment.

We will have counselors and mentors who are also physical trainers to be able to help in not only the physical space, but the mental and spiritual space as well.

Last, but not least, I am looking forward to doing working my way into local and national law enforcements good graces again to continue my Search And Rescue operations with my Non-Profit “Rescue The Universe”. I understand this will not be an overnight completed task, and I will need to prove myself as an exemplary citizen again in order to work with law enforcement to save lives during Hurricanes and other natural disasters again.

I am ready for the challenge, and look forward to overcoming any and all obstacles life has to throw at me.

12: Advisors –

Right now, I have no Case Manager or Counselor until I arrive at my final destination.

The other advisors that I have in life right now are:

a: Joseph McBride (attorney)
b: Brad Guyer (Attorney)
c: Bonnie Nichols (Wife)
d: Don & Patti Nichols (Parents)
e: Mr.. and Mrs.. Lajoie (Sunday School Teachers)

I look forward to gathering more advisors in my life who can help me achieve the goals and targets I want to achieve while incarcerated and upon release.
