I just came back from the Law Library finishing with my 2255 motion. I am turning in the motion because I was charged with a Conspiracy to possess with intent to distribute cocaine, and it was enhanced to a career offender charge based off of two prior Robbery convictions, one in 1997 and another one in 2009. But the law states that Conspiracy is no longer considered a predicate offence because it doesn’t require an overt act. So thats the reason for the motion. My Lawyer failed to raise these issues at court, and the fact that I had already signed a plea deal with the government that didnt envolve the career offender. Thats what I been working on as of late. Thank you for allowing me to share.
